1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the website, online services, ordering features, and any related offerings made available by Phil & Sebastian & Sebastian Coffee Roasters (“we,” “us,” “our,” or the “Company”), operating through the website bombit.pro and associated channels.
By visiting our website, placing an order, making a purchase, reserving a service, or otherwise using our services, you agree to be bound by these Terms and all applicable laws and regulations in Canada, including applicable provincial and federal consumer protection, privacy, and commercial laws. If you do not agree to these Terms, you must not use our services.
You represent that you are of the age of majority in your province or territory of residence, or that you are using the services with the consent and supervision of a parent or legal guardian.
2. Scope of Services
Phil & Sebastian & Sebastian Coffee Roasters operates a coffee-shop business and may provide, without limitation:
- Sale of coffee beverages, tea, food items, packaged goods, and related merchandise;
- In-store, pickup, and/or online ordering services, if available;
- Gift cards, loyalty programs, promotions, and special offers, where offered;
- Customer support and account-related communications;
- Any other services expressly made available through our website, premises, or authorized channels.
We reserve the right to modify, suspend, or discontinue any product, menu item, service, feature, or availability at any time, subject to applicable law and any express commitments we have made to you.
Product descriptions, images, pricing, and availability are provided for convenience and may change without notice. We may correct errors, inaccuracies, or omissions at any time, including after an order has been placed, to the extent permitted by law.
3. User Obligations and Responsibilities
When using our services, you agree to:
- Provide accurate, current, and complete information when placing orders, creating accounts, or contacting us;
- Use our services only for lawful purposes and in accordance with these Terms;
- Not attempt to disrupt, damage, or interfere with our website, systems, staff, premises, or operations;
- Not engage in fraudulent activity, abuse of promotions, chargeback abuse, or misuse of loyalty or gift card programs;
- Comply with all applicable health, safety, conduct, and property rules while on our premises;
- Ensure that any payment method used by you is authorized and valid;
- Respect the rights, privacy, and safety of our employees, contractors, and other customers.
You are responsible for maintaining the confidentiality of any account credentials, order information, or access details associated with your use of our services. You must promptly notify us of any unauthorized use or suspected security incident.
We may refuse service, cancel transactions, or restrict access where we reasonably believe a user has violated these Terms, engaged in unlawful conduct, or created a safety, security, or operational risk.
4. Payment Terms and Conditions
Prices are generally listed in Canadian dollars (CAD) unless otherwise stated. Applicable taxes, fees, deposits, delivery charges, or service charges may be added to your purchase as required or disclosed at checkout or at the point of sale.
All payments must be made using an accepted payment method. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided and authorize us, or our third-party payment processors, to charge the total amount due.
If a payment is declined, reversed, charged back, or otherwise not successfully completed, we may cancel the order, withhold fulfillment, or suspend related services, subject to applicable law.
We may use third-party payment processors. Their use may be governed by separate terms and privacy policies. We are not responsible for errors or security incidents attributable solely to third-party payment providers, except to the extent required by applicable law.
5. Cancellation and Refund Policy
Because we provide food and beverage items, many purchases are final once prepared, fulfilled, or delivered, except where a refund or replacement is required by applicable law or where we determine, in our discretion, that an error or product issue occurred.
- In-store purchases: Prepared food and beverage items are generally non-refundable once delivered to the customer, except in cases of verified mistake, defective goods, or other circumstances required by law.
- Online or pickup orders: Orders may be cancelled only before preparation begins, unless otherwise stated at checkout or prohibited by law.
- Gift cards and promotional items: Gift cards, promotional credits, and similar value instruments may be non-refundable except as required by applicable law.
- Refund timing: Approved refunds, if any, may be issued to the original payment method within a reasonable period, subject to processing times of the relevant financial institution.
If you believe there is an issue with your order, please contact us promptly with your receipt or order details. We may request reasonable supporting information before determining whether a refund, replacement, or store credit is appropriate.
Nothing in this section limits any non-excludable consumer rights under applicable Canadian law.
6. Liability Limitations
To the fullest extent permitted by applicable law, Phil & Sebastian & Sebastian Coffee Roasters and its directors, officers, employees, agents, contractors, affiliates, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising out of or related to your use of our services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount you paid to us for the specific product or service giving rise to the claim, or CAD $100, whichever is greater, except where a different limitation is prohibited by law.
We do not exclude or limit liability where it would be unlawful to do so, including liability for gross negligence, wilful misconduct, or other liability that cannot be excluded under applicable Canadian law.
Food and beverage products may involve allergens, cross-contact risks, caffeine, dairy, nuts, gluten, and other ingredients or sensitivities. While we may provide ingredient or allergen information, it is your responsibility to review product information and make choices appropriate to your dietary needs.
